Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the valet trash and recycling pickup service ("Service") provided by Calvir & Co. ("Calvir," "we," "us," or "our") to residents and property managers ("you" or "Customer") at participating buildings in Tbilisi, Georgia. By signing up for, paying for, or using the Service, you agree to be bound by these Terms.

2. The Service

Calvir provides nightly, door-to-door collection of household trash and recyclables from participating residential units, sorts the material, and transports it to the appropriate disposal or recycling facility. Standard collection windows and the exact steps of the service are described on our website and may be updated from time to time.

3. Service Area & Enrollment

The Service is available only at buildings and units we have agreed to service, either directly with an individual resident or through an agreement with a property manager or building owner. We may decline or discontinue service to any address at our discretion, including where access, safety, or volume make service impractical.

4. Fees & Billing

Current pricing is listed on our website and is billed per unit, either weekly or monthly as selected at signup. Payment is due in advance of the period it covers: your first payment is required before your first collection, and each following payment is due before the start of the next billing period. We do not require long-term contracts or minimum terms. Prices may change with at least 14 days' notice before the change takes effect for existing customers. If payment for an upcoming period is not received on time, we may pause collection until payment is made.

5. Cancellation & Refunds

You may cancel the Service at any time by notifying us at the contact details below. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods except where required by law or at our discretion.

6. Your Responsibilities

To receive service, you agree to:

• Place trash and recycling in the designated area by the posted pickup time;
• Bag all trash securely and keep recyclables reasonably free of contamination;
• Limit standard nightly collection to one trash bag per unit; if you expect to have more than one bag out on a given night, let us know in advance so we can plan for it — additional bags may be declined or subject to an extra charge at our discretion;
• Not place hazardous, flammable, medical, or otherwise regulated waste, construction debris, or large/bulk items (furniture, appliances, electronics) out for collection without prior arrangement; and
• Comply with your building's own rules regarding waste disposal, where applicable.

We may decline to collect items that violate these requirements, and repeated violations may result in suspension or termination of service.

7. Property Access

You authorize Calvir staff to access common areas and, where applicable, the immediate exterior of your unit's door during posted collection windows for the sole purpose of collecting trash and recycling. We are not authorized to, and will not, enter individual units.

8. Missed Pickups & Service Interruptions

We aim to collect on every scheduled service night but cannot guarantee uninterrupted service. Missed pickups may occur due to weather, building access issues, items placed after the collection window, non-compliant items, or circumstances beyond our reasonable control. If we miss a scheduled pickup due to our own error, we will collect at the next opportunity or, at our discretion, issue a service credit.

9. Limitation of Liability

To the maximum extent permitted by law, Calvir's total liability for any claim arising from the Service is limited to the amount you paid us in the three (3) months preceding the claim. We are not liable for indirect, incidental, or consequential damages, or for loss or damage to items not placed for collection in accordance with these Terms. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Indemnification

You agree to indemnify and hold Calvir harmless from claims, damages, or expenses arising from your violation of these Terms or your misuse of the Service, except to the extent caused by our own negligence or willful misconduct.

11. Suspension & Termination

We may suspend or terminate service to any unit or building for non-payment, safety concerns, repeated non-compliant waste, or any other reasonable business reason, with notice where practicable.

12. Force Majeure

We are not responsible for delays or failures in performance resulting from causes beyond our reasonable control, including extreme weather, natural disasters, labor disputes, government action, or disruption to disposal facilities.

13. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on our website with an updated "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of Georgia, without regard to conflict-of-law principles, unless otherwise required by applicable consumer protection law.
